1. **Individual Responsibility and Conduct**
Participants are responsible for their own actions during events and games. The organization is not liable for any injuries, damages, or losses incurred. Participants must act respectfully, avoiding physical, verbal, and online aggression, and adhere to ethical behavior. Engaging in sabotage, cheating, or deceptive activity is strictly prohibited. Participants must respect public and private property. Any damage caused by participants will be their responsibility. The organization is not liable for any fines, debts, or damages.
2. **Eligibility**
Participants must be U.S. citizens with a valid driver's license and a valid U.S. shipping address for the duration of their membership. Non-U.S. citizens must have a valid ID and access to a valid U.S. shipping address. Canceling membership revokes the right to claim any eligible prize. Participants under 18 years of age must have a parent or guardian's permission to join and to claim any prizes. Participants must be eligible for prize claims posted during the initial month of sign-up and going forward from their sign-up and registration date. If a participant cancels their subscription and then re-signs up at a later date, they cannot claim prizes from events that occurred during their previous membership.
3. **Account Registration and Verification**
Participants must register an account on the official website to join events and games. The organization reserves the right to verify eligibility for prize claims.
4. **Teamwork and Prize Claims**
Participants are encouraged to work together but can only claim prizes individually. Sharing information about prize claim codes and instructions is prohibited. Prizes can only be claimed once and must be claimed immediately to remove the risk of loss. Participants can claim prizes within their registered tier levels. There is no limit to how many prizes an individual participant can claim. The organization is not responsible for any loss of claims.
5. **Fair Play**
Participants must behave ethically and avoid sabotage, cheating, or any deceptive activity. Encouraging social media participation to log their journey is required for safety and security.
6. **Legal Compliance**
Participants must comply with all local, state, and federal laws. The organization reserves the right to involve law enforcement if necessary.
7. **Termination of Participation**
Participants can withdraw their participation at any time by canceling their tier subscription via the official channels. Unsubscribing revokes eligibility for any unclaimed prizes. The organization reserves the right to terminate a participant's account for violating any of these terms and conditions.
8. **Privacy and Data Use**
Personal information collected during registration and participation will be used solely for event management, prize distribution, and communication. By participating, you agree to receive updates and information through the official website, social media, and mailing lists. Our website uses cookies to enhance user experience and track participation.
9. **Content Ownership**
All content, including but not limited to clues, puzzles, and challenges, is the intellectual property of the organization. Unauthorized distribution or use of this content is prohibited. Participants retain ownership of any content they create and share, but grant the organization a license to use it for promotional purposes. Use of the organization’s logos, trademarks, and other proprietary content is prohibited without prior consent.
10. **Changes to Terms and Conditions**
The organization reserves the right to modify these terms and conditions at any time. Participants will be notified of significant changes via the official website, social media, and mailing lists.
11. **Dispute Resolution**
Disputes will be resolved by the organization to maintain fairness. The organization's decision on disputes is final.
12. **Liability Waiver**
By participating, you agree to release the organization from any liability related to your participation in events and games. Conservation of nature and protection of infrastructure must always be minded by all participants.
13. **No Actual Treasure Hunting**
Although participants are referred to as "treasure hunters," they are not participating in actual treasure hunting as defined by U.S. law.
14. **Governing Law and Jurisdiction**
These terms and conditions are governed by all federal and applicable state laws, and any disputes will be subject to the jurisdiction of the courts in Arapahoe County, Colorado.
15. **Force Majeure**
The organization is not responsible for any delays or cancellations due to unforeseen events such as natural disasters, strikes, or other events beyond our control.
16. **Refund Policy**
Refunds for subscription cancellations are handled on a case-by-case basis. Please contact customer service for more information. The organization is not responsible for any loss of claims.
17. **Indemnification**
Participants agree to indemnify and hold harmless the organization from any claims, damages, losses, liabilities, and expenses arising from their participation.
18. **Severability**
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
19. **Modification of Events**
The organization reserves the right to modify or cancel events without prior notice.
20. **Assignment**
Participants cannot transfer their accounts or rights to someone else without the organization’s prior written consent.
21. **Third-Party Links**
The organization is not responsible for the content or practices of third-party websites linked to from our official channels.
22. **Disclaimer of Warranties**
The organization provides events and games "as is" without any warranties regarding the experience.
